Assessment order passed without obtaining valid approval from specified authority is liable to be quashed

• Assessment Year: 2018-19

Where Assessing Officer issued a reopening notice on ground that assessee had fraudulently availed input tax credit (ITC) based on fake inward GST invoices, since said notice was issued beyond a period of three years from end of assessment year, Assessing Officer was statutorily obligated to have obtained approval from either of authorities specified under section 151(ii), however, Assessing Officer had obtained approval from Pr. Commissioner i.e. an authority who was not vested with any jurisdiction as per mandate of section 151 (as made available on statute w.e.f. 1-4-2021), impugned assessment so framed by him was liable to be quashed.
