I.   THE COMMISSIONER OF INCOME TAX Vs. M/S O.P.CHAINS LTD., INCOME TAX APPEAL NO. - 90 OF 2010, ORDER DATE : 13.12.2010, HIGH COURT OF ALLAHABAD

The Tribunal in its order has mentioned that the assessee had produced the names, addresses, PAN account details and affidavit, resolution of the Board of Directors and also necessary documents filed before the Registrar of the Companies that had invested in the shares of the assessee. It is in view of this that the Commissioner (Appeals) as well as Tribunal deleted it. This is a finding of fact. There is no illegality in the same.

II.   THE COMMISSIONER OF INCOME TAX VS. M/S ARPAN FRAGRANCES PVT. LTD, INCOME TAX APPEAL NO. - 700 OF 2007, ORDER DATE :- 3.12.2010 HIGH COURT OF ALLAHABAD

If the order u/s 263 passed by the CIT is quashed, the order passed u/s 144 is pursuance of order u/s 263 will not survive.
