Incentive received by assessee as levy sugar released for free sale, claimed by the assessee    as capital receipt but the Assessing Officer has treated it to be revenue receipt. Appeal filed by department is dismissed by Uttarakhand HC.

Commissioner could not have refused to entertain the revision on the ground that it is not a substitute of appeal, though there may be many more reasons, but such reasons have to be germane to the issue and valid. Allahabad HC CIT set aside the order of CIT.
